We are so glad you will be joining us for KAJABI HERO LIVE 2023 Virtual Event (the “Virtual Event”). By registering for the Virtual Event, you are agreeing to these terms, which form a legal contract between Kajabi, LLC (“Kajabi”, “we”, “our”), and the registered attendee (“Attendee”, “you”, “your”). This Agreement is a binding contract between you and Kajabi, so please read it carefully.

In consideration of being permitted to access the Virtual Event activities and in recognition of Kajabi’s reliance on your commitments, you agree to adhere to the code of conduct and all of the terms and conditions set forth in this Agreement. 

Registration and Rates:  Once you complete the purchase of your registration, the purchase and rate are final and won’t be adjusted later. It is your responsibility to confirm that the price displayed at checkout is correct before you complete your purchase. 

Kajabi will provide you with login credentials for the Virtual Event. These credentials are to remain confidential and are the property of Kajabi. Please don’t share your login credentials. They may not be given or transferred to any third party without our permission. You agree that you will not provide or permit others to use your login credentials. 

Cancellations:  We are sorry, but all ticket sales are final for the Virtual Event. No refunds will be given if you cancel your registration.

Electronic Communication:  Kajabi will communicate with attendees of the Virtual Event by email or by posting communications to the Kajabi website. You consent to receive communications from Kajabi electronically. You agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.

Assistance and Accommodations:  We’re happy to help. If you need any special accommodations, please let us know and we will do our best to arrange assistance for you to participate in the Virtual Event.

Your access to the Virtual Event:  The Virtual Event is a web-based event that can be accessed through desktop or mobile devices using the link provided in the confirmation email sent to you. The Virtual Event can be accessed live or for a limited time after the live event has taken place. 

You are responsible for any technical requirements needed to access the Virtual Event platform, website, or app in order to facilitate your participation in the Virtual Event. You will need to be sure to have the following in order to access the Virtual Event:

  • Browser:  Make sure you are using the latest version of Chrome, Firefox, Safari, Edge, Internet Explorer 11 (if webcast is enabled), Opera or iOS version (if using a mobile app).
  • Connection Speed:  The minimum download and upload speed is 2Mbps. If you fail to meet this minimum, you may experience interruptions and poor audio and video quality during the Virtual Event. If you are on a slower connection, please choose webcast mode, if available.
  • Firewalls and Proxy:  Assumed by default is that TCP ports 80 and 443 are open. Some firewall rules only allow for TCP traffic over port 443, make sure that all traffic can pass over this port. More information is listed here.
  • Operating System:  Make sure that you are using the latest version of your chosen operating system. Check your operating system here.

Privacy Notice:  Any attendee information that may be collected in connection with the Virtual Event will be used by Kajabi and its affiliates for legitimate business purposes in accordance with our Privacy Policy. We may share information about you within Kajabi and transfer it to countries in the world where we do business in accordance with our Privacy Policy. This information may also be shared with vendors offering services, such as our event support agency, as well as check-in, badging, or mobile apps, related to the Virtual Event. Kajabi may also access and/or disclose your information if we believe such action is necessary to (a) comply with the law or legal process served on Kajabi; (b) protect and defend the rights or property of Kajabi (including the enforcement of our agreements); or (c) act in urgent circumstances to protect the personal safety of other attendees, Kajabi employees or contingent staff, users of Kajabi services, or members of the public.

Kajabi uses BigMarker to facilitate the Virtual Event. By registering for the Virtual Event, you agree that Kajabi can share your personal information with BigMarker for the purpose of you accessing the Virtual Event.

Prohibition of Use of Event Content:  Kajabi and the Virtual Event speakers have worked extremely hard to create and develop the content that you will receive at the Virtual Event. We want you to fully implement the content in your own personal and professional life, but we also want to remind you that all intellectual property rights in and to the Virtual Event and the content and all materials distributed at or in connection with the Virtual Event are owned by Kajabi or the applicable speaker. You are not permitted to make your own video or audio recordings of the Virtual Event, or use any photographs or screenshots of the Virtual Event for commercial purposes. 

You will not reproduce any materials distributed or shown to you in connection with the Virtual Event. You will not use the name, trademark, logo, or other property of Kajabi or any Virtual Event speaker’s biographical information, including but not limited to, their name, likeness, or logo. You will not create audio or video recordings of any Event presentation, in whole or in part, given by Kajabi or any Virtual Event speaker, or simultaneously broadcast or live-stream any Virtual Event presentations. This means, among other things, that you cannot teach or train others in any Virtual Event content or any materials distributed at or in connection with the Virtual Event.

Event Code of Conduct; Attendee Content

The Virtual Event includes features that allows Attendees to post questions, comments, messages, and other content (collectively, “Attendee Content”). Some attendees may have access to additional networking features that enable them to directly contact other attendees who have access to the same features (“Community Features”). Attendee Content may be: (a) visible to any attendee who accesses the Virtual Event or any particular session within the Virtual Event (“Public Content”); (b) visible only to any attendee with access to the Community Features in which it is posted (“Community Content”); or (c) visible only to the individual attendee to which it is addressed, using any private messaging functionality within the Virtual Event (“Private Content”). 

You must not post, link to, or otherwise publish any Attendee Content that:

  • is not your original work or that infringes the copyright or other rights of any third party;
  • contains any form of advertising or promotion for goods and services or any spam or other form of unsolicited communication;
  • is threatening, offensive, libelous, indecent, or otherwise objectionable or unlawful;
  • is discriminatory in nature for example, comments that make attacks on the grounds of race, religion, sex, gender, sexual orientation, disability, or age;
  • personally attacks any speaker or any other individual participating in the Virtual Event; or
  • contains software viruses, files, or code designed to interrupt, destroy, or limit the functionality of the Kajabi site, the Virtual Event, or any computer software or equipment. 

Kajabi reserves the right to monitor and review any Public Content and Community Content. We also reserve the right to access and review any Private Content if a complaint has been made by the recipient. We may remove any Attendee Content that is potentially in breach of these terms or ban an attendee from posting any further Attendee Content or eject them from the Virtual Event. You acknowledge that Kajabi cannot control or monitor all Attendee Content posted by others. Therefore, we cannot guarantee that all attendees will behave in compliance with these terms nor can we guarantee the accuracy, integrity, or quality of any Attendee Content.

If you post any Public Content, you are granting Kajabi and its affiliates a right to use, publish, archive, modify, delete, or commercially exploit such Public Content, in whole or in part as we see fit, without any requirement to pay you for this and with or without attribution to you. You also grant us the right to use your name, likeness, or biographical details, as it relates to the Public Content for any and all purposes deemed appropriate by Kajabi, which may include, but are not limited to, commercial, promotional, or marketing purposes throughout the world in any form, medium, or technology now known or later developed. This means that you grant to us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free license to use any Public Content you publish in whole or in part in any manner and for any purpose and without further obligation to you. 

Event Agenda: We try to avoid it, but sometimes plans have to change. Therefore, you acknowledge and agree that Kajabi, in our sole discretion, reserves the right to change any and all aspects of the Virtual Event, including but not limited to, the Virtual Event name, themes, content, program, speakers, venue, and time.


We will do our best to provide you with an excellent and positive experience, but we do not warrant or guarantee that any particular results will come from your attendance at the Virtual Event. You understand that implementation of the principles and tactics described during the Virtual Event is a highly individualized and subjective process that may lead to different results for different people; thus, we cannot guarantee that you will, for example, experience an increase in your business or income, productivity or improved work-life balance. Individual experiences will vary.

We give no warranties in respect of any aspect of the Virtual Event or any materials related thereto or offered at the Virtual Event and, to the fullest extent possible under the laws governing this Agreement, disclaim all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. We do not accept any responsibility or liability for reliance by you or any person on any aspect of the Virtual Event and/or any information provided at the Virtual Event.

Other than to the extent required as a matter of law, we shall not be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement. Our maximum aggregate liability for any claim in any way connected to the Virtual Event or this Agreement whether in contract, tort, or otherwise (including any negligent act or omission) shall be limited to the amount paid by you to us to attend the Virtual Event.

Force Majeure:  Kajabi is not responsible or liable for any delay or failure in performance of its obligations hereunder to the extent such delay or failure is caused by fire, flood, earthquakes, hurricanes, unseasonably extreme inclement weather, strikes, labor disputes, inability to secure sufficient labor, civil, governmental or military authority, government requisitions, restrictions or regulations on travel, facility availability, commodities or supplies, civil disturbance, transportation, acts of God, acts of terrorism or threats of terrorism, acts of war, accidents, epidemics, disasters, the unavailability of a venue or any other cause beyond its reasonable control. In any such event, Kajabi may postpone, reschedule, or cancel the event without liability on the part of Kajabi.  In the event the Virtual Event cannot be held or is postponed pursuant to this section, Kajabi will refund you the price paid for the ticket but shall not be liable to Attendee for any damages, costs, or losses incurred, such as transportation costs, accommodations costs, or financial losses.

General Agreement and Governing Law: This Agreement constitutes the sole and entire agreement of Kajabi and you with respect to your attendance at and participation in the Virtual Event. If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. This Agreement is binding on and shall inure to the benefit of Kajabi and Attendee and our respective successors and assigns. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule. Any claim or cause of action arising under this Agreement may be brought only in the federal and state courts located in Orange County, California and Attendee hereby consents to the exclusive jurisdiction of such courts.

Kajabi may at any time refuse access, remove, or block any person from the Virtual Event platform who fails to comply with these terms and conditions. Attendees agree to comply with all reasonable instructions issued by Kajabi to participate in the Virtual Event.  

Kajabi reserves the right to modify or amend these terms and conditions at any time, which changes shall take effect upon notification to Attendee via any medium of communication available.

Attendee understands that Kajabi has no duty or obligation to provide Attendee with access to the Virtual Event. By signing this Agreement, registering for the Virtual Event, and/or accessing the Virtual Event, Attendee intends for this Agreement to be legally binding. A signed copy of this Agreement delivered by means of electronic transmission or a checked box agreeing to these terms is deemed to have the same legal effect as delivery of an original signature.
